Klimo Insights LLC, a North Carolina limited liability company (“Klimo Insights,” “Company,” “we,” “us,” or “our”), respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.

This Privacy Policy describes how we collect, use, disclose, retain, and protect information when you access or use:

  • www.klimoinsights.com;
  • wbgt.klimoinsights.com and any other Klimo Insights subdomains;
  • the Klimo WBGT mobile applications;
  • Klimo Insights emails, alerts, support services, and other products or services that link to this Privacy Policy;

collectively, the “Services.”

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, you should not access or use the Services.

1. Information We Collect

The information we collect depends on how you interact with the Services and which features you use.

Information You Provide to Us

We may collect information that you provide directly to us, including:

  • Your name, email address, username, password, and other account-registration information.
  • Information associated with your Klimo WBGT account, subscription, plan, and account preferences.
  • Locations, Sites, site names, addresses, coordinates, settings, policies, thresholds, and other information you save within the Services.
  • Photographs, documentation, notes, activity records, SmartTrack session information, and other materials you upload or create.
  • Information you voluntarily provide through Personal Heat Profile or similar personalization features.
  • Notification preferences, including your choices regarding email, push, SMS, weather, heat, lightning, and emergency alerts.
  • Messages sent through Klimo Chat, customer support, feedback forms, surveys, issue reports, or other interactive features.
  • Information you provide when requesting assistance, reporting a problem, participating in a promotion, or otherwise contacting us.
  • Any other information you choose to provide.

Please do not submit confidential medical records, protected health information, or other highly sensitive information unless a feature expressly requests that information and explains how it will be handled.

Location Information

Certain features rely on location information to provide geographically relevant WBGT, weather, heat-risk, lightning, alert, forecast, and Site information.

With your permission, we may collect or process:

  • Your device’s precise or approximate geographic location.
  • Latitude and longitude coordinates.
  • Locations you search for, view, save, create, or associate with a SmartTrack session.
  • General location inferred from your IP address.
  • Location information included in uploaded photographs or other content.

You may disable location access through your browser or device settings. Some features may not operate properly without location access.

Transaction and Subscription Information

When you purchase or manage a subscription, the transaction may be processed by an app marketplace, payment processor, or other third-party provider.

We may receive information such as:

  • The subscription product purchased.
  • Subscription status.
  • Transaction or purchase identifiers.
  • Purchase, renewal, expiration, cancellation, and refund information.
  • The marketplace or payment channel used.
  • Limited billing or customer information supplied by the payment provider.

We generally do not receive or store your complete credit or debit card number when payment is processed by a third-party provider. The provider’s handling of payment information is governed by its own privacy policy and terms.

Device, Technical, and Usage Information

When you access or use the Services, we and our service providers may automatically collect information such as:

  • Internet Protocol address.
  • Browser type and version.
  • Device type, manufacturer, model, operating system, and language.
  • Mobile application version and client platform.
  • Device and application identifiers.
  • Push-notification tokens.
  • Referring and exit pages.

  • Search activity and interactions with the Services.

We may associate this information with your account when you are signed in.

Communications and Support Information

  • Relevant Site, weather, alert, SmartTrack, device, application, and runtime context.

Support and issue-report information may be made available to authorized members of our team and to service providers used to manage support requests.

We and our service providers may use cookies, web beacons, software development kits, pixels, local storage, and similar technologies to:

  • Provide current and forecasted WBGT, weather, heat-risk, lightning, and alert information.

  • Operate Sites, SmartTrack, Personal Heat Profile, documentation, notification history, and other product features.
  • Personalize content, settings, thresholds, and user experiences.
  • Process and verify purchases, subscriptions, renewals, cancellations, and entitlements.
  • Deliver transactional emails, push notifications, SMS messages, and in-application alerts that you request or enable.
  • Respond to questions, feedback, support requests, and issue reports.
  • Send service announcements and important account, security, legal, or operational notices.
  • Analyze use, adoption, performance, reliability, and effectiveness of the Services.
  • Debug errors and improve application functionality.
  • Detect, investigate, prevent, and respond to fraud, abuse, unauthorized access, security incidents, and violations of our Terms of Use.
  • Protect the rights, property, safety, and security of Klimo Insights, our users, and others.
  • Comply with laws, regulations, legal processes, and enforceable governmental requests.
  • Establish, exercise, or defend legal claims.
  • Carry out any other purpose described to you when information is collected.
  • Carry out another purpose with your consent.

We may use information that has been aggregated or de-identified for analytics, research, product development, forecasting, business planning, and other lawful purposes. We will not attempt to re-identify information that has been de-identified unless permitted by law.

3. Alerts and Communications

You may choose to receive email, push, SMS, or in-application alerts relating to weather, heat conditions, WBGT, lightning, Sites, SmartTrack, account activity, subscriptions, or other Services.

These communications may be transactional and based on the preferences you select.

You may manage certain communications through:

  • Your Klimo WBGT notification settings.
  • Your device’s notification settings.
  • Links included in applicable emails.
  • Your browser settings.
  • Your account settings.
  • Instructions included in an SMS message.
  • A request sent to us.

Disabling notifications does not prevent us from sending essential communications concerning your account, security, subscription, legal notices, or material changes to the Services.

Alerts may be delayed, incomplete, unavailable, or affected by device settings, network availability, third-party systems, or other factors. You should not rely on Klimo Insights as your only source of emergency or safety information.

4. How We Disclose Information

We may disclose information in the following circumstances.

Service Providers

We may provide information to contractors, vendors, and service providers that perform services on our behalf, including providers of:

  • Cloud hosting and data storage.
  • Authentication and account management.
  • Databases and application infrastructure.
  • Mapping, geolocation, weather, forecast, environmental, and alert data.
  • Payment and subscription processing.
  • Email, SMS, and push notifications.
  • Analytics and traffic measurement.
  • Advertising and advertising measurement.
  • Error monitoring, logging, diagnostics, and application performance.
  • Customer support, chat, and internal collaboration.
  • Security, fraud prevention, and legal compliance.

These providers may process information only as needed to perform services for us, subject to their agreements with us and their own legal obligations.

App Marketplaces and Payment Providers

We may exchange subscription, entitlement, transaction, application, device, and account information with an app marketplace or payment provider to:

  • Process purchases.
  • Confirm subscription status.
  • Restore purchases.
  • Manage renewals and cancellations.
  • Address refunds and disputes.
  • Detect fraudulent transactions.
  • Provide customer support.

Your use of those providers is also subject to their privacy policies and terms.

Weather, Mapping, and Location Services

Information such as coordinates, requested locations, device information, or network information may be transmitted to mapping, geocoding, weather, lightning, alert, or environmental-data providers when necessary to deliver a requested feature.

Analytics and Advertising Partners

We may permit analytics and advertising providers to collect or receive device, browser, usage, cookie, identifier, approximate-location, and interaction information.

These providers may use information to:

  • Measure traffic and feature use.
  • Provide aggregated reporting.
  • Diagnose performance.
  • Measure advertising.
  • Select or limit advertisements.
  • Prevent fraud.

Depending on the applicable law and the technology used, certain advertising disclosures may be considered a “sale,” “sharing,” or use for targeted advertising even when no money is exchanged for personal information.

Business Customers and Organizations

When an account, Site, subscription, or service is provided or managed by an employer, school, team, organization, or other business customer, authorized administrators of that organization may be able to access information associated with the organization’s account.

This may include user identity, Sites, settings, activity, documentation, SmartTrack sessions, alerts, and other information created through the organization’s service.

Legal and Safety Disclosures

We may disclose information when we believe disclosure is necessary or appropriate to:

  • Comply with a subpoena, court order, law, regulation, or legal process.
  • Respond to a lawful request from government or law-enforcement authorities.
  • Enforce our Terms of Use or other agreements.

  • Protect the rights, property, safety, or security of Klimo Insights, our users, or others.
  • Establish, exercise, or defend a legal claim.

Business Transactions

We may disclose or transfer information in connection with a merger, acquisition, financing, investment, reorganization, bankruptcy, sale of assets, corporate conversion, or similar business transaction.

Any successor or acquiring entity may continue to process information in accordance with this Privacy Policy unless you are notified otherwise.

With Your Direction or Consent

We may disclose information when you direct us to do so, request an integration, use a sharing feature, or otherwise consent to the disclosure.

Aggregated or De-identified Information

We may disclose information that has been aggregated or de-identified so that it cannot reasonably be associated with you.

5. Sale and Sharing of Personal Information

We do not sell personal information in exchange for direct monetary payment.

However, some analytics, advertising, cookie, pixel, or similar technology disclosures may be treated as a sale, sharing, or targeted advertising under certain United States state privacy laws.

Where required by applicable law, eligible users may request to opt out of:

  • The sharing of personal information for cross-context behavioral advertising.
  • The processing of personal information for targeted advertising.

6. Data Retention

  • Comply with legal, tax, accounting, and regulatory requirements.
  • Resolve disputes.
  • Enforce agreements.
  • Prevent fraud and abuse.
  • Maintain security and business records.

Retention periods vary depending on the type of information and the reason it was collected.

When information is no longer reasonably necessary, we may delete, anonymize, or aggregate it. Information may remain in backups, archives, logs, fraud-prevention systems, or records that we are legally required to maintain.

Deleting an account may not immediately remove information from all backup systems. We may also retain limited information necessary to document the deletion request, comply with law, prevent fraud, or enforce our agreements.

7. Your Privacy Choices

Account Information

You may review or update certain account and profile information through the Services.

You are responsible for keeping your information accurate and protecting your login credentials.

Location Permissions

You may enable or disable location access in your browser or device settings. Disabling location access may prevent certain current-location, Site, weather, forecast, alert, and SmartTrack features from operating correctly.

Deleting a saved Site does not necessarily delete other records that were previously associated with that Site, such as alerts, documentation, support records, or SmartTrack history.

Camera and Photo Permissions

You may control camera and photo-library access through your device settings. Disabling these permissions may prevent you from capturing or uploading Site photographs or attachments.

Notifications

You may manage push notifications through Klimo WBGT or your device settings. You may manage other alert channels through the preferences made available in your account.

Cookies and Analytics

Most browsers allow you to block, limit, or delete cookies. Your mobile device may also provide controls for analytics, advertising identifiers, and tracking permissions.

These controls are provided by your browser, operating system, or device manufacturer and may differ by platform.

Account Deletion

You may request deletion of your account and associated personal information through the account-management functionality made available in the Services or by emailing legal@klimoinsights.com.

We may need to verify your identity before completing the request.

Certain information may be retained when permitted or required by law, including transaction records, security records, legal records, and information needed to prevent fraud or enforce our agreements.

8. United States State Privacy Rights

Depending on where you reside and subject to applicable exceptions, you may have the right to request that we:

  • Confirm whether we process your personal information.
  • Provide access to personal information we maintain about you.
  • Correct inaccurate personal information.
  • Delete certain personal information.
  • Provide a portable copy of certain personal information.
  • Disclose the categories of personal information we collect, use, or disclose.
  • Disclose the categories of sources from which personal information was collected.
  • Disclose the purposes for collecting or processing personal information.
  • Disclose categories of third parties to which information was provided.
  • Opt you out of certain sales, sharing, targeted advertising, or profiling.
  • Limit certain uses or disclosures of sensitive personal information.
  • Review or appeal a decision we make concerning your privacy request.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

To submit a request, email legal@klimoinsights.com with the subject line “Privacy Request” and describe the right you wish to exercise.

We may request information needed to verify your identity and authority to make the request. An authorized agent may submit a request where permitted by law, but we may require proof of the agent’s authority and verification of the consumer’s identity.

If we deny an eligible request, you may appeal the decision by replying to our response and clearly stating that you are submitting a privacy appeal.

9. Children’s Privacy

The Services are offered and available only to users who are 18 years of age or older.

The Services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13.

If you believe a child has provided personal information to us in violation of this Privacy Policy, contact legal@klimoinsights.com. We will investigate and take appropriate action, which may include deleting the information.

Schools, teams, employers, parents, guardians, and other organizations should not provide us with a child’s personal information unless they have the authority and any legally required consent to do so.

10. Data Security

We use administrative, technical, and organizational safeguards designed to protect information from accidental loss and unauthorized access, use, alteration, or disclosure.

These safeguards may include authentication controls, access restrictions, encrypted communications, monitoring, logging, backups, and server-side authorization controls.

However, no internet transmission, wireless transmission, storage system, or security measure is completely secure. We cannot guarantee the absolute security of information.

You are responsible for:

  • Protecting your password and account credentials.
  • Using a secure device and network.
  • Signing out of shared devices.
  • Promptly notifying us of suspected unauthorized account access.

Please contact us immediately if you believe your account or information has been compromised.

11. International Users and Data Transfers

Klimo Insights is based in the United States, and the Services are operated primarily from the United States.

If you access the Services from outside the United States, your information may be transferred to, stored in, or processed in the United States or another country where we or our service providers operate.

Data-protection laws in those countries may differ from those in your jurisdiction. Where required, we will use appropriate safeguards for international transfers.

12. Third-Party Services and Links

The Services may contain links to, integrations with, or content from third-party websites, applications, platforms, payment providers, app marketplaces, mapping providers, weather providers, advertisers, or other services.

We do not control the privacy or security practices of independent third parties. This Privacy Policy does not apply to information collected directly by those third parties.

You should review the privacy policies and terms of third-party services before providing information to them.

13. User Contributions and Shared Information

The Services may allow you to submit messages, photographs, documentation, comments, feedback, Site information, or other content.

Information you intentionally make available to another user, organization, administrator, public feature, or third-party service may be viewed, saved, copied, or further disclosed by those recipients.

Do not submit information about another person unless you have the right and authority to do so.

We may review, preserve, remove, or disclose user-provided content when reasonably necessary to:

  • Operate and support the Services.
  • Enforce our Terms of Use.
  • Investigate abuse or security incidents.
  • Protect users or the public.
  • Comply with legal obligations.

14. Health and Safety Information

Klimo WBGT is a weather, environmental-information, forecasting, and decision-support service. It is not a healthcare provider, medical service, emergency service, or substitute for professional medical advice.

Information you voluntarily enter into a Personal Heat Profile, SmartTrack session, Site, documentation record, or support request may relate to heat exposure, physical activity, or personal characteristics.

Unless expressly agreed otherwise in writing, Klimo Insights is not acting as a healthcare provider or business associate under the Health Insurance Portability and Accountability Act.

Do not use the Services to store medical records or regulated health information unless we expressly authorize that use.

15. Changes to This Privacy Policy

We may revise this Privacy Policy from time to time.

When we make changes, we will post the updated Privacy Policy and revise the “Last modified” date. We may provide additional notice when changes are material, such as through the Services, by email, or through another appropriate communication.

Your continued use of the Services after an updated Privacy Policy becomes effective indicates your acknowledgment of the updated policy, to the extent permitted by law.
